Agreement to Terms

By accessing or using Kachi AI's platform and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

Description of Service

Kachi provides an AI visibility and attribution platform that helps businesses track how AI systems discover, cite, and drive traffic to their content. Our services include:

• Server log analysis for AI bot activity
• AI visibility metrics and dashboards
• Integration with analytics platforms (GA4, GSC)
• Attribution and conversion tracking

Account Terms

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized access
• You may not use the service for any illegal purposes

Acceptable Use

You agree not to:

• Violate any applicable laws or regulations
• Interfere with or disrupt the service
• Attempt to gain unauthorized access to any systems
• Use the service to transmit malware or harmful code
• Resell or redistribute the service without authorization

Data and Privacy

Your use of Kachi is also governed by our Privacy Policy. You retain ownership of your data. By using our service, you grant us the right to process your data as necessary to provide the service.

Intellectual Property

The Kachi platform, including its design, features, and content, is owned by Kachi AI and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. Enterprise clients may have separate SLA agreements.

Limitation of Liability

To the maximum extent permitted by law, Kachi AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

Indemnification

You agree to indemnify and hold harmless Kachi AI from any claims, damages, or expenses arising from your use of the service or violation of these terms.

Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms to the extent such failure or delay is caused by circumstances beyond that party's reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation, facilities, fuel, energy, labour, or materials, or failures of third-party internet infrastructure or hosting providers. The affected party shall promptly notify the other party and use commercially reasonable efforts to resume performance as soon as practicable.

Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the use of our services, the parties agree to the following process:

1. Informal resolution — Either party may initiate the process by sending written notice to the other party describing the dispute. The parties will attempt to resolve the dispute informally through good-faith negotiation for a period of 30 days from receipt of such notice.
2. Mediation — If informal resolution fails, the parties agree to attempt non-binding mediation before a mutually agreed mediator. The costs of mediation shall be shared equally.
3. Binding arbitration — If mediation does not resolve the dispute within 60 days, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Delaware, United States. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
4. Class action waiver — Any arbitration shall be conducted on an individual basis. You waive any right to participate in a class action, class arbitration, or representative proceeding.

Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm.

Termination

We may terminate or suspend your account at any time for violation of these terms. Upon termination, your right to use the service ceases immediately. You may request an export of your data prior to account deletion.

Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes. Continued use after changes constitutes acceptance of the new terms.

Governing Law

These terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Subject to the Dispute Resolution section above, any legal action shall be brought exclusively in the state or federal courts located in Delaware.

Security & Responsible Disclosure

We take the security of our platform and users seriously. If you discover a potential security vulnerability in Kachi AI's systems or website, please report it to us responsibly before public disclosure so we can investigate and remediate.

To report a security issue, email [email protected] with a description of the vulnerability, steps to reproduce, and any supporting evidence. We will acknowledge receipt within 5 business days and keep you informed of our progress. We do not take legal action against researchers who report issues in good faith under this policy.
